DATA Privacy Information

Legal Basis and Purpose of Processing

Magna processes your Personal Data based on your consent, unless applicable law provides another legal basis such as the legitimate interests of Magna. If you have granted Magna consent to process your Personal Data, processing will only take place in accordance with the purposes set out below.

Purposes of Processing

• Digital graphic assets include graphic supports for press releases, web pages, mobile apps, social media ads/cards, posters, presentations, invites, banners, promo graphics, brochures, reports, newsletters, brand standards guide, workbooks, headers, signage/posters, digital displays, ads for recruiting, events, charity and functional groups, executive leadership messages, and sponsorship and community service materials (including ads, banners, photos), internal training of employees, awareness initiatives, employee contests and events.
• Physical graphic assets include invites, event posters, stickers, scan cards, t-shirt designs, brochures, reports, newsletters, MAFACT boards, signage/posters, backwalls, wall art, and magazines or flyers.
• Video, animation or audio assets include use in press releases, web pages, mobile apps, presentations, invites, banners, brand standards digital guide, digital displays, events including charity, group and functional group events, executive leadership messages, ads, internal training of employees, awareness initiatives, employee contests and events, and overview videos.
• Content can be used on MagnaNOW (digital signage system), Magna’s websites (including magna.com), Magna’s intranet sites (including Magnet), social media, Media Manager (digital asset management system), and digital and physical publications including MagnaPeople.
• Content will be updated and managed in Magna’s digital asset management system for use on a recurring basis.
• Continuity of use with approved quality standards is ensured.

Storage of Personal Data

Your Personal Data will be stored until you withdraw your consent. Notwithstanding the foregoing, your Personal Data may be stored and used for longer periods (i) as necessary to meet Magna’s legal obligations under applicable law (in this case, Magna may have to store your Personal Data even if you withdraw your consent), (ii) as necessary for fulfilling the contractual relationship to you, (iii) as necessary for purposes related to your employment or (iv) for historical reference, for example, in instances where your Personal Data is connected with an important historical event. Nevertheless, Magna ensures that Magna’s media are regularly reviewed, and outdated Personal Data is removed.

Data published in social media cannot be deleted but will be archived and not publicly visible. Material in which you can be recognised and in which you are primarily shown shall be removed from Magna’s website without delay and shall not be used in new printed media. If you are shown together with other people in a photo/video, the photo/video does not have to be removed; it is sufficient for your face to be blurred on the photo/video.

Your Rights

You have the right to obtain information, correction, deletion or restriction of the processing of your stored data at any time, the right to object to processing and a right to data portability in accordance with the requirements of data privacy laws, which you can address to the Controller. Furthermore, you have the right to lodge a complaint with the responsible supervisory authority.

Access to Personal Data (Recipients)

In order to process your information in connection with the abovementioned purposes, your Personal Data may be shared and accessed by authorized personnel within Magna (“Authorized Personnel”). As a result, your Personal Data may be transferred to and/or accessible by affiliates within Magna in countries other than your home country, including countries outside of the European Union/European Economic Area for which the European Commission has not issued an adequacy decision (meaning that the level of data protection may not be as high as within the European Union). Magna will ensure that your Personal Data is protected adequately wherever the data is transferred to or accessed by affiliates within Magna and that such affiliates will process your Personal Data in accordance with applicable data protection laws. Authorized Personnel permitted to access your Personal Data have been obliged to maintain data secrecy and confidentiality of your Personal Data. Magna has implemented appropriate technical, organizational, and physical measures to protect your Personal Data, in particular against accidental, unauthorized or unlawful destruction or loss, alteration and disclosure. 

Your digitally published Personal Data may be accessible worldwide and may be found via search engines. Furthermore, the Personal Data can be copied, downloaded, distributed, and connected with other information resulting in a profile, even if it is deleted on Magna’s media.

Magna further retains third party service providers (“Data Processors”) in connection with providing approved services to Magna for the creation, production, and/or distribution of images, video and audio for usage in a variety of media and related administrative services.
